The BotEyes Public Delivery Agreement

The BotEyes robot manufacturer and seller is BotEyes LLC, hereinafter referred to as the "Company", "BotEyes" or "we" operates the https://boteyes.com website (the “Site”), where buyers (“Customers”) can purchase robotics products (“Products”) sold by BotEyes. BotEyes provides the Site and sells the Products subject to the following terms and conditions. These Conditions of Use and Sale (the “Conditions”) form a legally binding contract between you (also sometimes referred to as “Customer”) and BotEyes in relation to your use of the Site and the purchase of Products. BotEyes reserves the right to modify at any time and without notification its Site and the Conditions. Therefore, please check these Conditions carefully each time you place an order with, or accept delivery of any Products from BotEyes. If you are not in agreement with one or many of these Conditions, please do not use the Site in any way and do not purchase Products.

All Products sold on the Site are believed to be of good quality and reliable. However, BotEyes warns against the use of Products in an application where an error or malfunctioning could result in damage to property, injury or even death of humans or animals. The primary responsibility for the use or operation of robots and robotics technology falls on the user.

Website Use

You agree to use Site only for purposes that are permitted by these Conditions. You agree that you will not access or attempt to access the Site other than through the interface that is provided by BotEyes, unless you have specifically been authorized to do so in a separate written agreement between you and BotEyes. You specifically agree not to access or attempt to access the Site through any automated means, including through the use of web scrapers or crawlers. You agree that you will not engage in any activity that disrupts or otherwise interferes with the functioning of the Site. You agree that you will not duplicate, reproduce, copy, distribute, or resell the Site or any of its content for any purpose. You agree that you are solely responsible for any breach of your obligations under these Conditions and for the consequences of any such breach.

Purchase Agreement

By accepting delivery of any Product purchased on the Site from BotEyes, Customer agrees to be bound by the terms and conditions listed below. You and BotEyes agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and BotEyes. Any attempt to alter, supplement, modify or amend these terms and conditions by Customer will be null and void. All purchase-sale transactions on the Site by Customer occur between BotEyes and the Customer.

Risk of Loss

Risk of loss and title for items purchased on the Site pass to Customer upon receipt of the item(s) by Customer.

Return Policy

We offer a 30 Day Money Back Guarantee for BotEyes robots. If you are returning the robot purchased from us within 30 days of receiving it, you can return product under the next conditions:

Refunds

Once we receive the robot, our service team will assess it. If the robot fits under our return criteria, you will receive a full refund. Your refund will be issued shortly thereafter and can take up to 30 business days to be fully credited back to your account.

Product Revisions

Vendors are not responsible for changes or modifications in Product specifications or physical appearance. In the interest of Customers, Vendors strive to ensure that all Product information is up-to-date and accurate. Vendors rely on the manufacturer to communicate changes or modifications about their products and Vendors have no way of alerting Customers prior to purchase in the event the manufacturer did not notify them. As a result, Vendors will not be held responsible for changes in Product specifications or other information.

Discounts

If you require multiple items, please ask for a quotation and we will determine if a discount can be provided or not. At that time, the nature of your order, any repeat business and the possibility of an ongoing partnership will all be evaluated in order to offer you the best possible price.

Warranty

We provide a one-year warranty on the robot for the original buyer. The warranty does not cover changes in the surfaces and appearance caused by natural wear and tear, as well as defects caused by improper use of the robot or accident. During the warranty period, we will send out any defective part free of charge, which the buyer can replace independently, using remote consultation with the manufacturer. Please note that BotEyes is not intended for outdoor use. Any such use will void the warranty. The warranty will not cover the shipping costs.

Limitation of Liability

WE SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, SPECIAL DAMAGES OR EXEMPLARY DAMAGES, WHETHER OR NOT WE HAVE BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

Security

Security is our priority. All payments made on our site by credit card are processed via proven techniques by 2Chekout.com. It uses payment tokenization eliminating payment data and ensuring that your sensitive personal information isn't compromised during a security breach.

All information sent to your bank, such as your credit card number, are encrypted according to industry standards. To ensure client confidentiality, 2Chekout.com will never sell, rent or divulge any of the personal information taken from the transactions to any entity other than BotEyes and your bank, in the case of any disagreement concerning your transactions.

Shipping

We deliver robots to any country of the World using UPS or DPD post service. As usual, delivery time and handling take about 10 working days after the payment is successfully processed. This includes order handling and customs clearance time (5 days) and post service shipment (5 days). We supply robots in plywood boxes with dimention 29.5 x 15 x 13.8 inches (75 x 38x 35 cm), the parcel weight is 55 lb (25 kg).

A tracking number will follow by email in 3-5 days after you have placed your order. We try to respect the delivery date shown; however, we are not responsible for delays caused by third parties that are not within our control (carriers, customs, etc.).

General Provisions

Governing Law and Jurisdiction

We will make every effort to resolve any dispute by negotiations.

If a negotiated agreement is not reached, the dispute, shall be referred for consideration and final resolution in the international commercial arbitration court.

Waiver

The failure of either party to require performance by the other party of any provision of these Conditions shall not affect in any way the first party’s right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in these Conditions shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement

These Conditions, together with our invoice regarding the Products ordered by Customer, are the complete and exclusive agreement between BotEyes and Customer, and they supersede all prior or contemporaneous proposals, understandings, representations, conditions, warranties, and all other communications between BotEyes and Customer relating to the such Products purchases, whether oral or written. These Conditions may not be modified or supplemented by any prior course of dealings or trade by custom or usage.

Customer and BotEyes agree that these Conditions have been entered into and interpreted in English.

Force Majeure

The parties shall not be liable for any partial or full failure to perform its obligations under these Conditions where such failure is the result of force majeure.

This Agreement constitutes the entire agreement between the parties pertaining to the subject matter hereof, and fully supersedes any and all prior or contemporaneous written or oral communications or agreements between the parties hereto respecting the subject matter hereof, including but not limited to any terms and conditions contained on any pre-printed forms, purchase orders, purchase order acknowledgement and invoice. We may amend any of the terms or conditions contained in this Agreement at any time and solely at our discretion by posting a new version of the Agreement.
